Terms & Conditions

These Terms & Conditions (“Terms”) govern the sale of products and services by Kowatek Solar LTD (“Kowatek,” “we,” “our,” or “us”) to the customer (“Customer,” “you,” or “your”). By purchasing any product or service from Kowatek, you agree to be bound by these Terms.
1. Company Information
Kowatek Solar LTD is a renewable energy and technology company, incorporated in Nigeria, specializing in solar and wind energy systems, energy storage, and related accessories.

2. Scope of Products & Services
Kowatek provides:
· Solar panels, inverters, batteries, and related equipment.
· Installation, system design, and after-sales maintenance.
· Consultancy and project-based renewable energy solutions.
All services and products are provided under these Terms.
3. Orders, Pricing & Payment
· All prices are subject to change without prior notice.
· Orders are confirmed only after payment is received and acknowledged.
· Accepted payment methods include bank transfer, card payments, and cryptocurrency (non-refundable).
· Risk of loss or damage passes to the Customer upon delivery.
4. Delivery & Installation
· Delivery times are estimates and may be affected by supply chain disruptions or regulatory changes.
· Kowatek is not liable for delays caused by third parties, customs, strikes, or force majeure.
· Installation is performed by qualified Kowatek technicians or her partners. Customers must provide safe site access (earthing), basic infrastructure, and comply with health and safety standards.
5. Returns, Refunds & Cancellations
· Standard products may be returned within 3 days of delivery, provided they are unused, in original packaging, and in resalable condition.
· Customized products, special orders, and installed systems are non-refundable.
· Refunds (where applicable) are processed within 14 business days and may exclude shipping/handling fees.
· Cryptocurrency payments are final and non-refundable due to volatility.
6. Warranties
· Products are covered only by the manufacturer’s warranty, subject to their terms.
· Installation services are covered by a 90-day workmanship warranty.
· All our capacity rating are accurate, however, Kowatek does not guarantee specific energy output, system uptime, or performance, as these depend on external factors (sunlight availability, customer usage, maintenance, environmental conditions),.
7. Limitation of Liability
To the fullest extent permitted by law:
· Kowatek shall not be liable for indirect, incidental, punitive, or consequential damages (including loss of profits, savings, or business opportunities).
· Liability is strictly limited to the cost of the product/service purchased, or repair/replacement at Kowatek’s discretion.
· Kowatek is not liable for:
- Customer misuse or negligence.
- Unauthorized modifications by third parties.
- Failures caused by poor maintenance, natural disaster, weather, or power grid instability.
8. Indemnity
The Customer agrees to indemnify and hold Kowatek harmless from claims, damages, or liabilities arising from:
· Misuse of products or services.
· Illegal use of generated electricity.
· Accidents or damages caused by third-party tampering.
· Non-compliance with installation/maintenance instructions.
9. Force Majeure
Kowatek is not liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to: natural disasters, government regulations, strikes, supply chain disruptions, terrorism, or war.
10. Intellectual Property
All system designs, proposals, installation drawings, software, and documentation remain the intellectual property of Kowatek unless expressly transferred in writing. Customers may not reproduce, distribute, or use them outside the agreed project scope.
11. Confidentiality
Any technical proposals, quotations, or project details shared with the Customer are confidential and must not be disclosed to third parties without Kowatek’s prior written consent.
12. Dispute Resolution
· Disputes shall first be resolved amicably through negotiation.
· If unresolved, disputes shall proceed to mediation/arbitration under Nigerian law.
· Courts in Delta State, Nigeria shall have exclusive jurisdiction if arbitration fails.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
14. Amendments
Kowatek reserves the right to update these Terms at any time. Updates will be published on our official website, and continued use of our products/services implies acceptance.
15. Acceptance
By purchasing from Kowatek Solar LTD, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
